1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Deflect, a sole proprietorship operated by Bhanu Teja Pachipulusu ("we," "us" or "our"), concerning your access to and use of the Deflect AI-powered customer support platform.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of any significant changes by updating the "Last Updated" date at the top of this page.
Your continued use of the Platform after such modifications will constitute your acknowledgment and agreement to the modified terms.
3. Payment Processing
Paddle.com is the Merchant of Record for all our orders. All payment issues are handled by Paddle.com, including order processing, billing information, and customer service inquiries related to payments.
When making a purchase, you will be providing your payment information to Paddle.com rather than to us. The processing of payments will be subject to the terms, conditions, and privacy policies of Paddle.com in addition to these Terms.
4. Subscription and Billing
Our Service is offered on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly, annually), depending on the subscription plan you select.
Subscription charges are non-refundable except as expressly provided in our Refund Policy. You may cancel your subscription at any time, but please note that such cancellation will be effective at the end of the then-current billing period.
5. Refunds
Our refund policy is outlined in our separate Refund Policy, which is incorporated by reference into these Terms.
6. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and disclose information from our users.
7. User Representations
By using the Service, you represent and warrant that:
- You have the legal capacity to enter into these Terms
- You will not use the Service for any illegal or unauthorized purpose
- Your use of the Service will not violate any applicable law or regulation
8. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Deflect. and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Deflect Inc.
9. Limitation of Liability
In no event shall Deflect, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
